Please take some time to read our terms and conditions (“Terms”) before using our mobile apps, website and any other related products and services offered by The Living Menu Pte. Ltd. (“Services”). You'll be legally bound by these Terms once you access or use our Services. We reserve the right to amend these Terms at any time without notice.

1. About Our Services

Living Menu is a platform managed by The Living Menu Pte. Ltd., a registered company in the Republic of Singapore. Through our mobile apps, we link you to daily curated menus (“Menus”) with a list of food items prepared by a list of vendors (“Vendors”), for a list of delivery times. The Services is also known and marketed as “Managed Food Service”. When you place an order, it will be consolidated by us and communicated to Vendors for preparations. When the food items are ready to be delivered, they will be picked up and delivered to you by Living Menu.

2. Service Availability

Living Menu’s Services is only available in selected area/communities. The available area/community is subject to changes without notice. All Menus are subject to limited quantity based on Vendor’s capacity for specific delivery times.

3. Food Items

While we make the best effort to communicate with Vendors, Living Menu does not guarantee the availability of food items on our Menus. If the food item you selected becomes unavailable after the order has been placed, we will inform you on the alternative food item, if it is available, as a potential replacement for your consideration. Otherwise, we will issue a full refund to you. Living Menu cannot guarantee that any of the food items sold by Vendors are free of allergens. Please contact the Vendor directly before placing any order if you have an allergy. Food pictures submitted by our vendors in app are for illustration purpose only. Actual product may vary.

4. Cancellation Policy

You can cancel your order on a food item with full refund (with the exception of the $0.50 payment processing fee) at anytime prior to the order cutoff time for the particular food item, which is vendor specific. Cancellation after the vendor’s order cutoff time is subject to the vendor’s policy. Living Menu cannot guarantee that cancellation after vendor’s order cutoff time will be issued with full refund. In the unlikely event of unforeseen exceptional circumstances, Force Majeure or catastrophes beyond our control, Living Menu reserves the right to cancel your order. If that occurs, any payment made for the cancelled order will be refunded.

5. Delivery

While we do our best effort to deliver your orders to you within the selected delivery timeslot, many factors such as Vendor’s ability to prepare food items on time, weather, traffic conditions, number of orders in your areas/communities and other circumstances, will affect our ability to ensure the timeliness of our delivery. By using our Services, you agree that both Living Menu and Vendors shall not be liable for any delay or non-performance caused by factors beyond our reasonable control.

6. Billing

Living Menu do not store your credit card details. We use Shopify Payments, a third-party payment processor, to bill your purchase. The processing of payments will be subject to Shopify Payment’s own terms and privacy policy (which can be found Here). Living Menu exercises no authority or control over Shopify Payments, and is not responsible for error by Shopify Payments. By choosing to order from Living Menu, you authorize Living Menu, through Shopify Payments, to charge your Payment Method any applicable fees and charges. Living Menu reserves the right to correct any errors or mistakes that Shopify Payments makes even if Living Menu has already requested or received payment.

7. Price and Fee Changes

We reserve the right to adjust pricing and fees at any time.

8. Liability

To the extent permitted by Law, The Living Menu Pte Ltd. is not responsible or liable for any direct, indirect, incidental, special and/or consequential damages or loss of profits of any kind whatsoever which may result from any use or access of, or any inability to use or access our Services. If you are dissatisfied in any way with our Services, your only solution is to cease using them. While we makes the best efforts to ensure that the information available in our mobile apps and website is accurate, it does not guarantee that any portion of our Services will be uninterrupted, reliable or error free, or that your use of our Services will meet your expectations. We will not be liable or responsible for any errors or omissions and reserve the right to change information published on our mobile apps and website at any time.

9. Review and Rating

By submitting reviews and ratings to Living Menu, you hereby grant Living Menu and its affiliates, sublicensees, partners, designees, and assignees of the Living Menu website, mobile apps and social media platforms (collectively, the “Living Menu Licensees”) a worldwide, non-exclusive, fully paid-up, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, distribute, modify, adapt, translate, prepare derivative works of, publicly display, publish, publicly perform, and otherwise exploit your review and rating submission and derivatives thereof in connection with Living Menu’s website, mobile apps and social media platforms and Living Menu’s (and its successors’) business, including, without limitation, for marketing, and promoting Living Menu’s business (and derivative works thereof), in any media formats and through any media channels now known or hereafter discovered or developed.

10. Use of Your Living Menu Account

You will need to register for a Living Menu account to use our Services via our mobile apps. When you register for a Living Menu account, you will need to provide personal information including a valid email address for verifications, a mobile phone number and a unique password. Your unique password should not be shared with anyone and should be kept confidential at all times. You are solely responsible for keeping your password safe. You accept that orders placed under your Living Menu account are your sole responsibility, except for fraud or abuse that are not your fault. If you wish to delete your Living Menu account, please send us an email. We may restrict, suspend or terminate your Living Menu account and use/access of our Services, if we reasonably believe that: Someone other than you is using your Living Menu account; or Where you are suspected or discovered to have been involved in any activity or conduct that is in breach of our Terms, policies and guidelines, or involved in activity or conduct which we deem in our sole discretion to be an abuse of our Services.

11. Severability

If any provision of this Terms is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.
